In a landmark judgment that could prevent further degradation of the Queen of Hills, the National Green Tribunal (NGT) has banned any new construction activity in green, forest and core areas, including entire portion around the circular Cart Road. Rapping the state government for allowing indiscriminate construction, the NGT ordered the constitution of a high-powered committee to maintain a check on any violations henceforth.
The Judgement bench: The 145-page landmark judgement was passed by a bench headed by NGT chairperson Justice Swatanter Kumar with Justice Raghuvendra S. Rathore (Judicial Member), besides Bikram Singh Sajwan and Dr. Nagin Nanda, both expert members, on a petition filed by Yogendra Mohan Sengupta, a Shimla citizen, who has raised his concerns on town facing unplanned growth and haphazard construction beyond its carrying capacity and had alleged collusion of the authorities, which are otherwise supposed to check such degradations and enforce norms.
Expert committee: The expert committee shall comprise two components: supervisory committee and implementation committee. The six-member supervisory panel, which would have to meet once every three months, will constitute experts from premier institutes such as Wadia Institute of Himalayan Geology, National Disaster Management Authority and Punjab Engineering College.
Other measures: Significantly, order also bars the Town and Country Planning (TCP) Department from regularising unauthorised constructions in the designated 17 green belts and the core area. Though the number of such constructions could be over 25,000 in the state, the highest concentration is in Shimla and suburbs.
