Abortion presents an ethical as well as moral dilemma . While procured abortion is a direct attack on a foetus with a lethal intent , it certainly should not be confused with the inadvertent loss of life of the foetus. Recently the SC’s order to allow the abortion of a 24 week old foetus of a rape victim has again triggered a debate. MTP ( Medical Termination of Pregnancy ) Act- Abortion of a foetus less than 12 weeks allowed while that of a foetus of 20-24 weeks with a prior permission of a medical boards. Owing to the shortage of medical staff abortion by Ayurveda , unani and siddha practitioners also allowed. The freedom of choice of women is limited to – 1. When continuing of pregnancy is a grave threat to the physical or mental ( in case of rape ) health of the mother. 2. If the child were born, it would suffer from such physical or mental abnormalities as to be seriously handicapped. The right of a women to choose and that of the foetus to survive needs to be balanced . Although the SC passed its judgments in favour of the mother in the case of (1) but when it comes to termination of pregnancy in case the foetus is predicted to be born with major disabilities it has always taken sides with the foetus , upholding the right to life of the foetus. Here in an inclusive approach is required Eg . Emulating the German model where in there is a mandatory counseling and a three day waiting period. Also providing more social security, financial aid and employment to mothers would constructively encourage them to give birth. Hence the mother should be assured of the well being of her foetus when it enters the world . Liberalisation of the abortion laws will although lead to lesser conflicts but it certainly deprives the foetus of its rights and hence proper counselling and aid ( social and economic ) is imperative to women.
